These Terms of Service (“Terms”) govern your use of this website and any services provided by Quintero Digital (“Quintero Digital,” “we,” “us,” or “our”). By accessing this website, submitting an inquiry, or purchasing or using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use this website or our services.



1. Services

Quintero Digital provides digital services that may include, but are not limited to:
• Website design and development
• UI/UX design
• SEO optimization
• Website maintenance and support
• E-commerce development
• Integrations, automation, and AI-based features
• Consulting and digital strategy

Services may be delivered as one-time projects, monthly retainers, or ongoing support agreements.



2. Project Scope and Changes

All services are delivered according to a mutually agreed scope, which may be outlined through email, proposal, invoice, contract, or other written confirmation.

Any work requested outside the agreed scope may require additional fees, timeline adjustments, or a revised agreement. Quintero Digital reserves the right to decline requests that materially alter the scope of a project.



3. Communication and Client Responsibilities

To complete projects efficiently, clients agree to provide timely access to all necessary materials or accounts, which may include:
• Hosting and domain access
• CMS or platform logins (WordPress, Shopify, Webflow, etc.)
• Brand assets (logos, colors, fonts)
• Content (copy, images, pricing, product details)
• Third-party services or tools

Project timelines depend on client responsiveness. Delays caused by missing materials, late approvals, or restricted access may extend deadlines without penalty to Quintero Digital.



4. Payments and Fees

Pricing may be provided via invoice, proposal, or written agreement. Unless stated otherwise:
• Deposits are non-refundable once work begins
• Full payment is required prior to final delivery, site launch, or transfer of files
• Late payments may result in paused work

For monthly plans or retainers, fees are billed on a recurring basis unless canceled in writing.



5. Refund Policy

Due to the custom nature of digital services, refunds are not guaranteed. If issues arise, Quintero Digital will make reasonable efforts to revise deliverables within the agreed scope.

Completed work, time spent, and delivered milestones are non-refundable.



6. Intellectual Property and Ownership

Client Materials

Clients retain ownership of all materials they provide and confirm they have the legal right to use them.

Deliverables

Upon full payment, clients receive rights to final deliverables created specifically for their project unless otherwise stated in writing.

Proprietary Tools

Quintero Digital may use internal tools, templates, code libraries, systems, or workflows. These remain the property of Quintero Digital unless explicitly transferred in writing.



7. Content Ownership, Control, and Responsibility

Quintero Digital acts solely as a service provider and technical developer. Unless explicitly stated otherwise in a written agreement, Quintero Digital is not the owner, operator, publisher, or controller of any website, application, or digital property developed for a client.

The client is solely responsible for all content associated with their website or digital property, including but not limited to:
• Text, images, graphics, videos, and media
• Product descriptions, pricing, and claims
• User-generated content
• Legal disclosures, policies, and notices
• Accessibility, copyright, trademark, and regulatory compliance

While Quintero Digital may provide guidance, recommendations, or best-practice suggestions regarding content, accessibility, or legal considerations, final responsibility and approval always remain with the client.

Any content, materials, edits, uploads, integrations, or changes added or modified by the client or third parties—before or after site launch—are entirely the client’s responsibility, even if Quintero Digital retains administrative access for maintenance or ongoing support.

In cases where Quintero Digital assists with domain registration, hosting, signage systems, or technical infrastructure, such assistance does not transfer ownership or content responsibility unless Quintero Digital explicitly owns and operates the domain, servers, or platform under a separate written agreement.

The client agrees to defend, indemnify, and hold harmless Quintero Digital from any claims, damages, liabilities, losses, or legal expenses arising from website content, client-provided materials, legal or regulatory non-compliance, or intellectual property violations.



8. Third-Party Platforms and Tools

Projects may involve third-party services such as hosting providers, CMS platforms, payment processors, plugins, integrations, analytics tools, or AI services.

Quintero Digital is not responsible for outages, policy changes, pricing changes, account restrictions, or service interruptions caused by third-party providers. All related fees and subscriptions are the client’s responsibility unless otherwise agreed in writing.



9. Website Use and Acceptable Conduct

You agree not to use this website or our services for illegal activity, fraud, malware distribution, copyright infringement, harassment, or abusive conduct.

Quintero Digital reserves the right to refuse service to anyone for any lawful reason.



10. Privacy and Confidentiality

Client information is handled responsibly and used only for delivering services. We do not sell client data.

Information may be shared only when required to complete services or comply with legal obligations. Please review our Privacy Policy for additional details.



11. No Guarantees

Quintero Digital does not guarantee specific results, including traffic, rankings, conversions, or revenue.

SEO performance, business outcomes, and platform behavior depend on many factors beyond our control.



12. Limitation of Liability

To the maximum extent permitted by law, Quintero Digital is not liable for any indirect, incidental, special, or consequential damages arising from:
• Use or inability to use deliverables
• Data loss, downtime, or interruptions
• Third-party platform issues
• Business losses or missed revenue

Quintero Digital shall not be liable for any claims related to website content, legal compliance, or regulatory matters where Quintero Digital does not own or operate the domain, hosting environment, or platform.

Total liability for any claim shall not exceed the amount paid to Quintero Digital for the applicable service.



13. Termination

Either party may terminate services in writing. Upon termination:
• The client remains responsible for completed work and outstanding balances
• Work may stop immediately
• Files, access, or deliverables may be withheld until payment is completed



14. Governing Law

These Terms are governed by the laws of the United States and, where applicable, the state in which Quintero Digital operates, without regard to conflict-of-law principles.



15. Updates to These Terms

Quintero Digital may update these Terms at any time. Continued use of services after updates constitutes acceptance of the revised Terms.
